الملخص
The public official is obligated in accordance with the Basic law of Public service Ordinance 06-03 and Ordinance 09-21 not to disclose professional secrets in general, and classified information and documents related to public authorities in particular, in the event of a breach of it, he is responsible. The research problem revolves around what are the obligations of the public official in accordance with Ordinance 09-21 to secure classified information and documents issued by the relevant authorities, and the responsibilities arising from violating them§ In this study, I relied on the descriptive analytical approach, through which I reached conclusions, including that Ordinance 09-21does not affect the citizen’s constitutional right to access information and documents. يلتزم الموظف العمومي طبقا للقانون الأساسي للوظيفة العمومية الأمر 06-03 والأمر21-09 بعدم إفشاء السر المهني عامة، والمعلومات والوثائق المصنفة المتعلقة بالسلطات العمومية خاصة، والهدف من البحث هو محاولة التطرق للمفهوم الواسع للموظف العمومي الذي تشمله تلك الالتزامات، مع تسليط الضوء عليها، وفي حالة مخالفتها تقوم مسؤوليته. تتمحور إشكالية البحث حول ما هي التزامات الموظف العمومي طبقا للأمر 21-09 بتأمين المعلومات والوثائق المصنفة الصادرة عن السلطات المعنية وما يترتب عن مخالفتها من مسؤوليات؟ وقد اعتمدت في هذه الدراسة على المنهج الوصفي التحليلي، من خلاله توصلت إلى نتائج منها أن الأمر 21-09 لا يمس بحق المواطن الدستوري في الوصول للمعلومات والوثائق.
