اتفاقية سيداو بين الالتزام الدولي والتحفظ عليها

الملخص

الملخص: تعد اتفاقية سيداو بمثابة مرجع دولي حقوقي ، للتأكيد على حقوق المرأة ومساواتها بالرجل في كل مجالات الحياة، إضافة إلى ما تفرضه من التزام دولي على الدول الأطراف باتخاذ إجراءات وفقا لما يتناسب مع ما نصت عليه،غير أنه في المقابل أبدت الدول العربية والإسلامية تحفظها على بعض المواد من الاتفاقية،لذلك تهدف هذه الدراسة إلى توضيح التقاطع بين الالتزام الدولي بهذه الاتفاقية الحقوقية الدولية والتحفظات التي أبدتها الدول فيما يتعلق ببعض المواد التي ترى فيها مساسا بثوابت شرعية وتجاوزا لبعض التقاليد والثقافات المجتمعية، حيث تعتبر المادتين 2 و 16 من أخطر المواد وأكثرها تحفظا، لنستنتج في الأخير أن من حق الدول التحفظ على كل ما يمس بثوابت الشريعة الإسلامية، وأن حق المرأة محفوظ ومكفول شرعا،لكن هذا لا ينفي أن المرأة تحتاج لبعض الحقوق التي من المفروض تتناسب مع المتغيرات الدولية المتغيرة والمتجددة،ليبقى السؤال مفتوح هل تحتاج المرأة فعلا لاتفاقية سيداو لإقرار وحماية حقوقها؟ الكلمات المفتاحية: اتفاقية سيداو ; الالتزام الدولي ; التحفظ ; الشريعة الاسلامية . Abstract: CEDAW is considered as an international legal reference which emphasizes the rights of women and their equality with men in all areas of life, in addition to the international obligation it imposes on the state parties to take measures in accordance with what it stipulates. However, the Arab and Islamic countries expressed their reservations about some articles of the agreement. Accordingly, this study aims at clarifying the intersection between the international commitment to this international human rights convention and the reservations made by states with regard to some articles in which they consider infringing the legal constants and transgressing some traditions and societal cultures, where Articles 2 and 16 are considered among the most dangerous and conservative articles. To conclude at the end that states have the right to reserve everything that affects the principles of Islamic law, and that the right of women is preserved and guaranteed by it, but on the other hand, some rights for women need to be commensurate with the changing and renewed international changes, so that the question remains open: do women really need CEDAW to recognize and protect her rights?
