الملخص

ملخص: يعدّ التسبيب الوجوبي بحق أحد أهم المكنات القانونية المكرسة للانتقال بالقرار الإداري من طور السرية الى عالم الشفافية وذلك كونه يجسد الإعلان والكشف في صلب القرار عن الحالات القانونية والواقعية التي تشكل أساسه، على نحو يسمح للأفراد معرفة الاسباب الحقيقة والفعلية التي تقف وراء اتخادها، وهو ما من شانه أن يرفع أيّ شك، ويزيل أي لبس أو سوء تأويل، ما يبعث على تفهمه والاطمئنان إليه، ويجعل المعني على بينة من أمره؛ فله إما الاقتناع والرضا بمضمونه أو رفضه وبالتبعية منازعته، وإدراكاً منه بأهمية الدور الهام والمفصلي الذي يلعبه التسبيب الوجوبي، فقد خطى المؤسس الدستوري الجزائري خطوة معتبرة في سبيل تكريسه؛ وذلك بموجب التعديل الأخير لسنة 2020، أين ألزم الإدارة كمبدأ عام بضرورة تعليل الردود على الطلبات المستوجبة لإصدار القرار الاداري، وهو ما يعتبر تعبيداً للطريق امام المشرع في انتظار تدخله باستحداث قانون خاص ومستقل ومتكامل ينظم تسبيب القرارات الإدارية، على غرار باقي التشريعات الإدارية المقارنة السابقة في هذا المجال. :Abstract Mandatory causation is one of the most important legal mechanisms devoted to moving the administrative decision from the stage of secrecy to the world of transparency, as it embodies the declaration and disclosure at the heart of the decision the legal and factual cases that form its basis in a way that allows individuals to know the real and actual reasons behind their adoption, which is what he would To raise any doubt and remove any confusion or misinterpretation that inspires his understanding and reassurance, and makes the concerned person aware of his matter. He has the mother of conviction and satisfaction with its content, or his rejection and dispute, realizing the importance of the important and critical role that the obligatory reasoning plays. The way to consecrate it, according to the last amendment of the year 2020, where is the administration obligated, as a general principle, to explain the responses to the requests required to issue the administrative decision, which is considered paving the way pending the intervention of the legislator by creating a special, independent and integrated law that regulates the causation of administrative decisions, similar to the rest of the previous comparative administrative legislation in this field.
