إختصاص القضاء الإداري بالفصل في منازعات رخص التعمير

الملخص
يعد موضوع منازعات التعمير من المواضيع الشائكة التي تواجه الإدارة، ذلك أنها تمثل تصادم مصلحتين مختلفتين. الأولى مصلحة خاصة بالملاك و الأفراد أصحاب الحقوق " حق الملكية " الذين يرغبون في ممارسة حقهم في الملكية. و الثانية مصلحة عامة أخذت بعين الاعتبار حماية المجتمع و فرض إجراءات الضبط في مجال التعمير. فبالرغم من المجهودات المبذولة من سنن للقوانين وإستحداثها و تنظيمها إلا أن الفشل كان نصيب العديد من المنازعات التي أبت أن تلتقي مصالح أطرافها. مرجعين أسباب هذا الفشل إما لنقص النصوص المنظمة لها أو أن هاته القوانين و التنظيمات مجرد حبر على ورق أو أنها لم تتماشى و الفكر السائد لدى الأفراد فأبوا إلا أن يخالفوها بإنتهاكات صارخة تزداد يوميا. ومنه فلا بد من إستحداث رؤية إستراتيجية جديدة تتماشى والتنوع العمراني وكذا الفكر السائد، الشيء الذي يمكن أن يحد من منازعات التعمير ويوصلنا إلى ترقية عقارية جيدة. Abstract: The issue of construction disputes is one of the thorny issues facing the administration, as it represents the clash of two different interests. The first is a vested interest for owners and individuals with rights to “property right” who wish to exercise their right to property. The second is a public interest that took into account the protection of society and the imposition of control measures in the field of construction. Despite the efforts made by Sunan to create and organize laws, failure was the share of many disputes that refused to meet the interests of their parties. Referring to the reasons for this failure, either for the lack of the texts regulating them, or that these laws and regulations are just ink on paper, or that they did not conform to the prevailing thought among individuals, so they refused to violate them with flagrant violations that increase daily. Hence, it is necessary to develop a new strategic vision in line with urban diversity, as well as the prevailing thought, which can reduce construction disputes and lead us to a good real estate upgrade.
