الملخص
الملخص: يتناول هذا المقال بالدراسة إشكالية احترام مبدأ التمييز الذي تنص عليه معظم القواعد الاتفاقية و العرفية في القانون الدولي الإنساني، خاصة مع التطورات الحاصلة في الوقت الحالي، و سنركز في هذا الصدد على الاستعمال المتزايد للطائرات بدون طيار في العمليات العسكرية، سواء في النزاعات المسلحة الدولية أو غير الدولية، و ما يصاحبها من إشكالات و آثار قانونية جديرة بالفحص و التعمق، من حيث دقة هذه الأسلحة خاصة في الحروب غير المتكافئة أي تزيد نسبة عدم احترام مبدأ التمييز، و هذا إذا كان الخصم جماعة مسلحة غير منتظمة أو مدنيين يشاركون مباشرة في الحرب، و نفس السياق ستعالج الدراسة وضع منتسبي الوكالة الأمريكية للاستخبارات، من حيث وضعهم القانوني، و شرعية مشاركتهم في الحرب، و شرعية ملاحقتهم القضائية، و هذا بناءا على تحديد مفهوم المقاتل، و المشاركة المباشرة في العمليات العسكرية، و تطور هذه المفاهيم. Abstract: This article deals with the study of the problem of respecting the principle of discrimination stipulated in most of the convention and customary rules in international humanitarian law, especially with the developments taking place at the present time, and we will focus in this regard on the increasing use of drones in military operations, whether in international armed conflicts or Non-international ones, and the accompanying problems and legal effects that deserve to be examined and in-depth, in terms of the accuracy of these weapons, especially in asymmetric wars, that is, the percentage of disrespect for the principle of discrimination increases, and this is if the opponent is an irregular armed group or civilians directly participating in the war. In the same context, the study will address the status of the employees of the American Intelligence Agency, in terms of their legal status, the legitimacy of their participation in the war, and the legitimacy of their prosecution, based on the definition of the concept of the fighter, direct participation in military operations, and the development of these concepts.
