الملخص
الملخص: تهدف هذه الدراسة إلى تحديد الالتزام بترحيل البحار باعتباره من الالتزامات الأساسية التي يرتبها عقد العمل البحري على عاتق المجهز، ذلك أن هذا الالتزام تمليه اعتبارات إنسانية تتمثل في مراعاة الظروف الخاصة برجال البحر. كما توصلنا من خلال هذه الدراسة إلى نتائج مهمة تتمثل في حماية مصلحة البحار نظرا لخصوصية العمل على متن السفينة، وهذا يتضح من خلال أحكام النصوص القانونية المنظمة للالتزام بالترحيل سواء على المستوى الوطني أو الدولي. Abstract: This study aims to define the commitment to repatriate the seafarer, as one of the fundamental obligations of the maritime contract signed with the ship-owner, and dictated by humanitarian considerations such as the special working conditions of seamen. Trough the present study, essential findings arose: Given the specific nature of work on board vessels, greater interest was given to protecting the seafarer’s interests, as it clearly appears from the provisions of the various legal texts governing the repatriation commitment issue.
