الملخص
الملخص: في حالة رفض العامل تحمل آثار العقوبة التأديبية المترتبة عنها، لهذا الأخير أن يحتج على تنفيذها أمام الجهة القضائية المختصة، مطالبا بإلغائها أو بدفع التعويضات جبرا للضرر اللاحق به. هذا النوع من الدعاوى يسمح للقاضي الاجتماعي برقابة مشروعية العقوبة التأديبية المتخذة، فاستنادا إلى موضوع الطلب القضائي المحدد في عريضة افتتاح الدعوى، للقسم الاجتماعي التأكد من حقيقة الخطأ المهني المنسوب للعامل المعني وجديته، وتراقب صحة التكييف المعطى للخطأ المهني طبقا للتكييف والتصنيف الشرعي له، ومدى تناسب العقوبة التأديبية المتخذة مع جسامة الخطأ المهني المرتكب، وأخيرا رقابة شرعية إجراءات التأديب. االتساؤل المطروح، ماهي الجوانب القانونية للعقوبة التأديبية المتخذة المشمولة بالرقابة القضائية؟ وماهي طبيعة السلطات المخولة للقاضي الاجتماعي بمناسبة رقابة مشروعية العقوبة التأديبية المتخذة ومدى اتساعها؟ الكلمات المفتاحية: الرقابة القضائية-العقوبة التأديبية –الإلغاء-التعويض-التسريح التعسفي- تطابق العقوبة مع الخطأ المرتكب. Summary : In the event that the worker refuses to bear the effects of the disciplinary punishment resulting from it, the latter has the right to protest against its implementation before the competent judicial authority, demanding its cancellation or payment of compensation for the damage caused to him. This type of case allows the social judge to monitor the legality of the disciplinary punishment taken. Based on the subject of the judicial request specified in the case opening petition, the social department has the right to verify the truth and seriousness of the professional error attributed to the concerned worker, and monitors the correctness of the conditioning given to the professional error according to the conditioning and legal classification thereof, and the extent of proportionality The disciplinary punishment taken with the gravity of the professional error committed, and finally the legitimacy control of the disciplinary measures.
