ضبط النشاط المصرفي: الاختصاص الأصيل للجنة المصرفية

الملخص
الملخص: أوكلت الدولة بعد انسحابها من الحقل الاقتصادي مهمة ضبط النشاطات الاقتصادية لسلطات الضبط الإدارية المستقلة، وتعتبر اللجنة المصرفية سلطة ضابطة في المجال البنكي إلى جانب مجلس النقد والقرض، وقد زودت في سبيل ضبط النشاط المصرفي باختصاصات هامة، لذلك وجب البحث في مدى كفاية النصوص القانونية المقررة لتأطير الوظيفة الضبطية المنوطة بهذه اللجنة. Abstract: After its withdrawal from economic domain, the Algerian State entrusted the task of controlling economic activity to the regulatory authorities in the economic and financial domain, the banking commission is the original authority as well as the council of currency and credit the guarantor of control of banking and financial activity, to achieve its objective the Algerian legislator has entrusted important powers to this regulatory authority, it is therefore necessary to seek in the adequacy of the legal texts determining the control function entrusted to this regulatory authority. Résumé : Après son retrait de domaine économique, l'État algérien a confié la tâche de contrôler l'activité économique aux autorités de régulation dans le domaine économique et financier, la commission bancaire est l'autorité originale ainsi le que le conseil de la monnaie et de crédit le garant de contrôle de l'activité bancaire et financière, pour atteindre son objectif le législateur algérien a confié des compétences importantes à cette autorité de régulation, il est donc nécessaire de chercher dans l'adéquation des textes juridiques déterminant la fonction de contrôle confiée à cette autorité de régulation.
