حكم إثبات الهلال بالمراصد الفلكية والحساب الفلكي -دراسة فقهية مقارنة-

الملخص
الحمد لله والصلاة والسلام على رسول الله أما بعد فإن مسألة إثبات الهلال بالمراصد الفلكية والحساب الفلكي من المسائل المهمة التي يكثر حولها الحديث في الزمن الحاضر، ورغبة مني في إماطة اللثام عن بعض جوانب هذه المسألة كتبت هذا البحث الذي تناولت فيه الأصل الشرعي في إثبات دخول الشهر وخروجه، ثم تناولت حكم إنشاء المراصد الفلكية الحديثة والاستعانة بها في رؤية الهلال، وختمت البحث بحكم استعمال الحساب الفلكي في تحديد الشهر، موضحا محل الوفاق والخلاف في المسائل السابقة، مع الإشارة إلى أدلة الآراء المختلفة، وسبب الخلاف ومنشئه، ثم الرأي المختار، وأنهيت البحث بخاتمة فيها أهم النتائج والتوصيات. Abstract: Praise be to Allah, and His prayers and peace be upon the Messenger of Allah. The issue of establishing the sight of the crescent moon (start of the lunar month) with astronomical observatories and calculation is one of the important issues about which a lot of debate has been taking place in recent years. With the endeavor of revealing some key aspects related to this issue, I decided to write this short communication. In this study, I first deal with the original Islamic way of establishing the entry and exit of the month followed by a discussion of the modern astronomical observatories and their role in sighting the crescent. The study then examins astronomical calculations for determining the start of the month. The points of concensus and disagreement related to the previous issues are explained. Reference is made to the evidences supporting the different opinions and the cause and origin of the dispute. Finally, the study concludes by presenting the chosen opinion followed by a conclusion in which the most important results and recommendations are highlighted.
