الملخص
ملخص: علم أصول الفقه من أهم ما أنتجه العقل المسلم، لأنه يقوم بتنظيم التفكير الفقهي في استنباط الأحكام، حتى وصف بأنه علم منطق الشرع، بل هناك من أطلق على علم الأصول منطق علم الفقه، ونادى بعضهم بضمه إلى حقل الفلسفة الإسلامية، وأن يدرس في إطارها إلى جانب علم الكلام. حتى جعل هذا العلم مقابل لعلم المنطق الأرسطي الفلسفي. إن علم أصول الفقه هو منهج البحث في كل ما يتصل بالعلوم الإسلامية، وجودة النظر الأصولي وحسن توظيفه للقواعد والأدلة المترابطة والمحكمة يساعد في تطوير مستويات الفهم ومنهجيات النظر للنصوص. لأن جزءا من هذه القواعد تحاول التعامل مع النص من جهة لوازمه العقلية وتنظم العلاقات بين الأدلة والقواعد. وهذه الدراسة تسعى لبيان العلاقة بين هذا العلم الشرعي الشريف وبين العلوم العقلية للتداخل بين المنهج الأصولي والنظر العقلي. كلمات مفتاحية: أصول الفقه؛ عقل؛ علم الكلام ؛ المنطق؛ الفلسفة. Abstract: The science of the principles of jurisprudence is one of the most important intellectual products created by the Muslim mind because it organizes jurisprudential thinking in developing decrees and rulings. It was even described as the science of the logic of Sharia. Even some scholars included it as part of Islamic philosophies and proposed studying it along with theology or "Ilm al-Kalām". They even consider this science opposite to the science of Aristotle's philosophy logic. The science of jurisprudence is the research methodology of everything related to Islamic sciences. The quality of fundamental consideration and its proper use of interrelated, interactive, and accurate rules and evidence help develop suitable levels of understanding and methodologies for treating texts and issues. This study aims to clarify the relationship between this honorable religious science and pure sciences and highlight the positive and negative aspects of the overlap between the jurisprudential approach and the rational method.
