الملخص
شهر الدعاوى العقارية تقتصر على تلك الدعاوى التي ترمي إلى الطعن في صحة التصرف الذي تضمنه العقد المشهر، بمعنى أنه يشترط في الدعوى أن تكون منصبة على حقوق عينية عقارية مشهرة. أما إذا لم تكن هذه الحقوق مشهرة فإنه لا يستوجب الأمر إخضاعها إلى الشهر طالما أن الحق العيني موضوع الخصومة القضائية غير مشهر لذا أوجب المشرع الجزائري أن تشهر كل العقود و المحررات الرسمية المتعلقة بالملكية العقارية بالمحافظة العقارية قبل تسليمها إلى أصحابها و هذا لضمان حقوق كل من طرفي العقد ، لأن العبرة في نقل الملكية العقارية بالشهر بالمحافظة العقارية و ليس من يوم إبرام العقد . و نتناول الدعاوى الواجب إشهارها و أثار شهر العريضة . الكلمات المفتاحية :شهر الدعوى ،الشهر العقاري ،الشهر المسبق ،أثار شهر الدعوى The announcement of real estate proceedings concern only those actions aimed at challenging the validity of the conduct contained in the reputable contract. In other words, the case is required to be focused on reputable real estate rights in kind. However, if these rights are not known, they do not have to be subject to an announcement so long as the right in kind is the subject of non-notorious litigation. The Algerian legislature had to publish all the Contracts and official editorials relating to real property in real estate before they are handed over to their owners. This is to ensure the rights of both parties to the contract. Because the lesson in transferring real property per announcing in real estate conservation.
