عقد الإمتياز كأسلوب لتسيير المرفق العمومي في الجزائر

الملخص
المرفق العمومي هو الهيكل الأساسي للنشاط الإداري، يلعب كبيرا في توفير الاحتياجات العامة للأفراد، وتقديم الخدمات اللازمة من متطلبات الحياة اليومية. وتختلف المرافق العمومية حسب اختلاف المهام الموكلة لها سواءً إداريا أو اجتماعيا أو مهنيا أو اقتصاديا، وكل هذه الأنواع من المرافق العمومية تخضع للقانون الإداري في تسيرها وفي المنازعات المتعلقة بها، كما أنها تخضع لأساليب تسيير مختلفة من التسيير المنفرد عن طريق القرارات الإدارية، إلى التسيير الإتفاقي عن طريق إبرام العقود الإدارية. ولعل عقد الامتياز يعتبر من أهم صيغ هذه العقود، غير أنه يخص المرافق العمومية ذات الطابع الاقتصادي دون غيرها، والسبب في ذلك يعود إلى إمكانية تخلي الإدارة عن تسير المرفق العمومي الاقتصادي لأشخاص القانون الخاص، وذلك نظرا لحرصهم على السير الحسن للمرفق العمومي حتى يتمكنوا من استرجاع نفقات تسييره بالفائدة المرجوة. وهذا ما سينعكس بالإيجاب على نوعية الخدمة التي يستفيد منها الأفراد من جهة، وعلى فعالية المرفق العمومي الاقتصادي الذي سعود بالربح على الخزينة العمومية للدولة، وقد أثبتت التجربة نجاعة هذا الأسلوب في تسيير المرافق الرياضية كالملاعب، والترفيهية كحدائق التسلية. Abstract: The public utility is the basic structure of administrative activity, and plays a major role in providing the general needs of individuals, and submitting the necessary services from the requirements of daily life. Public utilities differ according to the different tasks assigned to them, whether administratively, socially, professionally or economically, and all these types of public utilities are governed by administrative law and in disputes related it, it is also subject to different management methods from individual management through administrative decisions, to consensual management through the conclusion of administrative contracts. And perhaps the concession contract is one of the most important forms of these contracts, but it pertains to public facilities of an economic nature only, and the reason for this is due to the possibility of the administration abandoning the running of the public economic facility for private law persons, due to their keenness on the good functioning of the public facility until they can recover their operating expenses with the desired interest. This will be reflected positively on the quality of service that individuals benefit from on the one hand, and on the effectiveness of the public economic facility, which makes profit on the state’s public treasury. Experience has proven the efficacy of this method in managing sports facilities such as playgrounds, and recreational facilities such as amusement parks.
