إِمكانيّة تسيير المِرفق العام بأُسلوب التفويض في الجزائر

الملخص
تبنى المُشرع الجزائري قاعدة عامة مفادها، أنّ جميع المرافق العامة قابلة للتفويض من حيث المبدأ، إِلا ما اُستثني منها بنص صريح وهذا النص قد يكون دستورياً أو تشريعياً أو حتى تنظيمياً. غير أنّه يُمكن لطبيعة المرفق العام التأثير في مدى اِخضاع تسييره لتقنية التفويض، خاصةً وأنَّ هذا الأسلوب ما وُجد إِلا لتحقيق النجاعة الاقتصاديّة والجودة في عملية التسيير، ومن هذا المُنطلق يُمكن القول إنّ تقنيّة التفويض تتلاءم نوعاً ما مع المرافق العامة ذات الطابع الاقتصادي، بالنظر للخصائص المالية المُشتركة التي يتميز بها هذا النوع من المرافق وتقنيّة التفويض، لكن مع ذلك يُمكن اِستبعاد بعضها بحُكم النص. أما المرافق العامة ذات الطابع الإداري فإنّها مبدئياً لا تتلاءم مع تقنيّة التفويض، وذلك لتعلق البعض منها بالنشاط السيادي للدولة أو خضوع بعضها لمبدأ المجانيّة، لكن على الرغم من ذلك لم يستبعدها المشرع الجزائري من دائرة التسيير بأُسلوب التفويض. كلمات مفتاحية: المِرفق العام، تقنيّة التفويض، النجاعة الاقتصاديّة، الخصائص الماليّة، الجودة في التسيير، الاستثناء الصريح. Abstract: The Algerian legislator has adopted a general rule that all public utilities are subject to delegation in principle, except for what is excluded from them by an express text, and this text may be constitutional, legislative, or even organizational. However, the nature of the public utility can influence the extent to which its management is subject to delegation technology, especially since this method was only found to achieve economic efficiency and quality in the management process. The common features of this type of facility and delegation technique, but nonetheless some of them can be excluded by virtue of the text. As for public utilities of an administrative nature, they are, in principle, not compatible with the delegation technique, due to some of them being related to the sovereign activity of the state or some of them being subject to the principle of gratuitousness, but despite this, the Algerian legislator did not exclude them from the management department by the method of delegation.
