تسوية العقارات في حساب المجهول والعقارات غير المطالب بها في القانون العقاري الجزائري

الملخص
ملخص : نتج عن اختيار الجزائر لنظام الشهر العيني مباشرة السلطات العمومية لأعمال المسح العام للأراضي على مختلف بلديات القطر الوطني ، مع الإبقاء على نظام الشهر الشخصي بصفة مؤقتــة ذلك بمقتضيات فنية وواقعية ، الأمر الذي أدى إلى تسليم الكثير من الأشخاص للدفاتر العقارية ، بالشكل الذي يعكس الوضعية القانونية والمادية لهذه الأملاك ويسهل عملية نقلها وانتقالها ، والتصرف فيها ؛ وعند الاقتضاء الحماية الإدارية والقضائية لها. غير أن عملية مسح الأراضي ، زيادة على التباطؤ الذي عرفته منذ بدايتها الأولى بمناسبة أعمال المسح الريفي التي رافقت تطبيق قانون الثورة الزراعية وقانون مسح الأراضي الصادر بالأمر 75-74 المؤرخ في: 12-11-1975 ، والمعاينات الميدانية والإحصائيات التي قدمتها المديرية العامة للأملاك الوطنية والوكالة الوطنية لمسح الأراضي أبانت عن ظهور حالة قانونية غير متعارف عليها ؛ في موضوع الترقيم العقاري عرفت بحالة حساب المجهول والتي تحولت فيما بعد إلى العقارات غير المطالب بها بموجب قانون المالية لسنة 2015 و سنة 2018 ، وما تبعهما من تنظيم بموجب المذكرة رقم 707 المؤرخة في 23/01/2020 ، والمذكرة 910 المؤرخة في 29/01/2020 ؛ ما أدى إلى ضرورة التدخل لتسوية هذه الوضعية القانونية العالقة التي أثرت على تطهير ملكية الأشخاص وعطلت عملية استثمارها. Abstract : Algeria's choice of the land publication system has led the public authorities to direct the work of the cadastre and general survey in the various communes of the country, while temporarily maintaining the real and personal publication system for these properties and facilitates, the process of their disposal, and elimination is necessary, administrative and judicial protection for it. However, the cadastre process, in addition to the slowdown it has experienced since its inception during the rural cadastre work that accompanied the implementation of the agricultural revolution law and the cadastre law promulgated by the Ordinance 75-74 of: 11-12 -1975, and the field surveys and statistics provided by the General Directorate of National Property ,The National Cadastre Agency revealed the emergence of an unknown legal situation; In terms of real estate numbering, I knew the case of the unknown account, which subsequently turned into unclaimed real estate under the finance law of 2015 and 2018, and the subsequent settlement under the note n ° 707 of 23/01/2020, and Note 910 of 29/01/2020; This has led to the need to intervene to resolve this pending legal situation, which has affected the cleansing of people's property and hampered the process of their investment.
