الملخص
الملخص: يعتبر مؤلف مصنف أدبي أو فني في مفهوم الأمر رقم 03/05 المؤرخ في 19 جمادى الأولى عام 1424 الموافق 19 يوليو سنة 2003، يتعلق بحقوق المؤلف والحقوق المجاورة، الشخص الطبيعي الذي أبدعه. يمكن اعتبار الشخص المعنوي مؤلفا في الحالات المنصوص عليها في هذا الأمر. يعتبر مالك حقوق المؤلف، ما لم يثبت خلاف ذلك، الشخص الطبيعي أو المعنوي الذي يصرح بالمصنف باسمه أو يضعه بطريقة مشروعة في| متناول الجمهور، أو يقدم تصريحا باسمه لدى الديوان الوطني لحقوق المؤلف والحقوق المجاورة، المنصوص عليه في المادة 131 من هذا الأمر. إذا نشر المصنف بدون اسم مؤلفه، فإن الشخص الذي يضعه بطريقة مشروعة في متناول الجمهور يعد ممثلا لمالك الحقوق ، ما لم يثبت خلاف ذلك. إذا نشر المصنف المجهول الهوية دون الإشارة إلى هوية من يضعه في متناول الجمهور، فإن ممارسة الحقوق يتولاها الديوان الوطني لحقوق المؤلف والحقوق المجاورة إلى أن يتم التعرف على هوية مالك الحقوق Abstract: The author of a literary or artistic work, within the context of Order No. 03-05 dated 19 Jumada I, 1424 corresponding to July 19, 2003 related to Copyrights and Neighboring Rights , shall be the natural person who creates it. The nominal person may be considered as the author in the cases provided for herein. Unless otherwise proven, the copyrights owner shall be considered the natural or nominal person who proclaims the work under his name, legally offers it to the public or submits a proclamation in his name to the National Bureau of Copyrights and Neighboring Rights, provided for in Article 131 herein. In case a work is published without the name of its author, the person who legally offers it to the public shall be considered a representative of rights owner, unless otherwise is proven. In case an anonymous work is published without indicating the identity of the person who offers it the public, the National Bureau of Copyrights and Neighboring Rights shall practice the related rights until the rights owner is identified.
