بناء المسائل الأصولية على إجماع الصحابة ـ رضي الله عنهم ـ في مباحث الألفاظ.

الملخص
الملخص: أحد أركان البناء الأصولي لمسائل أصول الفقه أقيم على: إجماع الصحابة ـ رضي الله عنه ـ ، أُخذت من نظرهم الشرعي، وفتاواهم، وتصرفاتهم الاجتهادية، وأصل هذا:عائد إلى أن أصول الفقه: أدلة الشريعة الإجمالية، وأصل الأدلة الإجمالية دليلان: الكتاب، والسنة، وما سواهما عائد إليهما، جاءا بلسان عربي مبين، والصحابة ـ رضي الله عنهم ـ أفصح العرب لساناً، وأجلاهم بياناً، وأوضحهم خطاباً، كانوا عرب الألسن؛ فاستغنوا بعلمهم به عن المسألة عن معانيه، مع كونهم ـ رضي الله عنهم ـ عايشوا الوحي، ونظروا في تدرج بناء الأحكام وفق أسبابها ؛ ففهموا السبب والمسبب، والخاص والعام، والمطلق والمقيد، والناسخ والمنسوخ، والمجمل والمبين، فجمعوا بذلك بين مدركي اللغة والشرع، وهما مدركان فاعلان في أصول الفقه؛ فجاء بناء الأصوليين لجملة من مسائل مباحث الألفاظ على إجماع الصحابة ـ رضي الله عنهم ـ منها: الأصل حمل العموم على عمومه ولا يحمل على أقل الجمع، والعام بعد التخصيص حجة، والحكم الوارد لصحابي يتعدى لغيره، ودلالة العام على أفراده قطعية عند الأحناف، وأن أقل الجمع ثلاثة، وأن ما ثبت في حقه عليه الصلاة والسلام ثبت في حق أمته، وأن الجماعة تدخل في خطاب الواحد، وحكاية العموم من الراوي تعم، ويجوز تخصيص العموم المتواتر بخبر الآحاد، وبالقياس، والعمل المستمر عند الصحابة يخصص به العموم. الكلمات المفتاحية: الصحابة؛ بناء؛ عموم؛ خصوص؛ أمر؛ نهي. Abstract: One of the pillars of fundamentalist inference: the consensus of the Sahaba, may God rest his soul on fundamentalist issues, was taken from their legitimate view, their jurisprudence and their ijtihad actions, and the origin of this: due to the fact that the origins of jurisprudence: the evidence of the total sharia, and the origin of the total evidence are two guides: the Book, the Sunnah, And whatever else belongs to them, they came with a clear Arabic tongue, and the companions, May God bless them, revealed a tongue, and postponed them a statement, and explained them in a speech, they were Arabs of tongues, so they dispensed with their knowledge of the issue about its meanings, although god bless them they lived the revelation, They considered the hierarchy of the building of judgments according to their reasons; Those who are among the issues of the semantics of words by the consensus of the Sahaba, may Allah be pleased with them, including: the origin carried the general public in general and does not carry on the least plural, and the general after allocation is an argument, and the judgment received by my companions goes beyond others, and the general indication of its members is categorical at the edges, and that the least plural Three, that what has been proven against him is proved against his nation, that the group is involved in one's speech, and the commons tale of the narrator prevails, and that the frequent public may be allocated to the news of Sundays, by analogy, and the continuous work of the Sahaba is allocated to the public.
