الملخص
ملخص يهدف هذا البحث في المساهمة للكشف عن الأطر القانونية التي تنظم تداول المكملات الغذائية بما يضمن حماية المستهلك، والمساهمة في استلهام الحلول من التجربة الفرنسية السبّاقة في هذا المجال؛ كون المشرع الفرنسي قد سّن قانوناً خاصاً بها؛ كما يسعى هذا المقال لوضع نظرة مستقبلية لتنظيم سوق هذه المنتجات. حيث تمّ التوصل في هذه الورقة البحثية أن القواعد العامة لم تعد تواكب عملية إنتاج وتداول المكملات الغذائية، حيث أصبح من الضروري سنّ مواد قانونية واضحة من شأنها أن تنص صراحة على موقف السلطات من التعامل مع المكملات الغذائية وإسنادها لجهة مختصة بما يسمح بمعالجة هذه المسألة بوضوح بعيداً عن كل التأويلات أو الاجتهادات وهو الإجراء الذي من شأنه إنهاء الفوضى السائدة في السوق. Abstract This research aims to clarifying the legal frameworks that regulate the trade of nutritional supplements to ensure consumer protection, and to inspiring solutions from the French experience, which was a pioneer in this field; Considering the issuance of a law to address its various aspects; this article also seeks to develop a future view of the regulation of these products market. It has been concluded in this research paper that the general rules no longer keep pace with the process of production and nutritional supplements trade, so that it has become necessary to enact a clear legal provisions to express the authorities position regarding dealing with nutritional supplements explicitly, and attributing it to a competent authority, which allows this issue to be clearly addressed, away from all interpretations or jurisprudence, a procedure that would end the chaos prevailing in the market.
