أثر إعادة الاعتبار في الاندماج الاجتماعي

الملخص
يقوم نظام رد الاعتبار بقسميه على قرينة حسن السلوك، يستهدف تحقيق حقوق الإنسان من خلال إعادة إدماج المحبوسين المفرج عنهم اجتماعيا للحد من الظاهرة الإجرامية هذا من جهة، ومن جهة أخرى هو اعتراف من المجتمع بأن المحكوم عليه قد أدى دينه نحو المجتمع، وهو المعنى الذي نفهمه من قول رسول الله صلى الله عليه وسلم في حق ماعز بعد إقامة الحد عليه: لقد تاب توبة لو قسمت بين أمة لوسعتهم، على هذا الأساس يتحدد إشكال هذا البحث في إيجاد المقاربة بين هذا النظام ونظام التوبة، ومن جهة أخرى بين النصوص القانونية لهذا النظام، وآليات التطبيق السليم لها. The Effect of The Rehabilitation in The Social Integration Both sides of The Rehabilitation System are based upon the good morals. It targets maintaining human rights through reintegrating the released prisoners in society so as to bring the criminal phenomenon to an end on one hand. On the other hand, the society should admit that those convicts have paid their debts as Al Hadith of Our Messenger Mohammed Peace Be Upon Him goes, when the guilty she-goat was punished, « Their repentance can satisfy all the individuals of my nation. » On this basis, our research aims to find an approach between such a system and the system of repentance and between the legal texts and the mechanisms which help us well apply them.
