"شرع من قبلنا" عند الصّحابة -رضي الله عنهم-.

الملخص
تهدف الدّراسة إلى الكشف عن مذهب الصّحابة –رضي الله عنهم- فيما ثبت من "شرع من قبلنا"، ولم يُنسَخ؛ هل يصلح عندهم دليلا من أدلّة الأحكام أو لا يصلح؟ مرورا بذكر آراء الأصوليّين في هذا الدّليل، مع التّركيز على أهمّ الأدلّة التي استدلّوا بها، وقبل ذلك بيان مواطن والوفاق والخلاف بين الأصوليّين في "شرع من قبلنا"، لتصل الدّراسة لتوظيف مذهب الصّحابة –رضي الله عنهم- للتّرجيح بين اختلاف الأصوليّين في هذا الدّليل. Artical Summary : The study aims to uncover the doctrine of the Companions –May Allah be pleased with them- regarding what was proven from « Shari’a of those before us » ; which was not abrogated. Do they have any of the evidance for rulings suitable or not ? Through mentioning the views of the Fundamentalists in this guide, with a Focus on the most important evidance they have made , and before that ; explaining the point of agreement and disagreement between the Fundamentalists in « Shari’a of those before us », so the study will reach the function of the doctrine of the Companians –May Allah be pleased with them-to arbitrate between the differences of the fundamentalists regarding this evidence.
