منهج ابن أبي زيد القيرواني من خلال كتابه النوادر والزيادات

الملخص
تهدف هذه الدراسة إلى بيان منهج الشيخ ابن أبي زيد القيرواني من خلال كتابه "النوادر والزيادات"، والذي يعد موسوعة فقهية ظهر فيها النضج العلمي والتميز المنهجي للمدرسة الفقهية المالكية عامة، وبرز فيها بشكل خاص المنهج التأصيلي الاستدلالي الذي اعتمده الشيخ في هذا الكتاب، لتفنيد ما شاع في الأوساط العلمية من أن التراث الفقهي المالكي يخلو في معظمه من الأدلة التفصيلية للمسائل الفقهية. ولقد استدعت هذه الدراسة، مزيجا متآلفا من عدة مناهج، وهي المنهج التاريخي الإستردادي وذلك للوقوف على ما كتب في كتب التاريخ الإسلامي والتراجم والسير عن ابن أبي زيد وعصره، والمنهج الإستقرائي والمنهج التحليلي وذلك من خلال تتبع مسائل باب الصوم في كتاب النوادر والزيادات، لاستكشاف منهجه وأسلوبه. Abstract: This study aims to explain the approach of Sheikh Ibn Abi Zayd al-Qayrawani through his book “Al Nawadir wa Al-Ziydat”, which is a jurisprudential encyclopedia in which the scientific maturity and methodological excellence of the idiosyncratic school of Al-Malikia appeared, in general, and in particular the inductive and inductive approach adopted by the Sheikh in this book, to refute what it is common in the scientific community that the idiosyncratic of Al-Malikia heritage is mostly devoid of detailed evidence for jurisprudential issues. This study called for a harmonious mixture of several approaches, namely the historical retrieval method, in order to find out what was written in the books of Islamic history and biography about Ibn Abi Zayd and his epoch , and the inductive method and the analytical method, by following the issues of the chapter of fasting in the book “Al Nawadir wa Al-Ziydat”, to explore his approach and style.
