العلاقة بين جودة تشريعات عقود الدولة و الحوكمة المالية و التنموية - قراءة نقدية في التجربة الجزائرية-

الملخص
ملخص: العقد هو أداة الدولة ومختلف وحداتها من أجل إنشاء وإدارة و استغلال المرافق العامة، فهذه الأخيرة عليها أن تواكب تطور تلك الاحتياجات بسبب تطور أنماط العيش و تزايد التعداد السكاني أيضا، ولهذا فان الإطار القانوني الذي يحكم عقود الدولة يعتبر جزء أساسي ومحوري في إطار حسن الإدارة المالية لهذه المرافق والعمل على تطويرها المستمر بالقدر الذي يتناسب مع حجم تطور المجتمع في تعداده وتغير حاجياته التي تفرضها تطورات المجتمع الإنساني . إن التجربة الجزائرية في هذا المجال يمكن أخذها كنموذج للوقوف على حجم العلاقة الطردية بين نوعية التشريعات والتنظيمات التي تحكم عقود الدولة والحوكمة في المجال المالي والتنموي ولهذا سيكون النظام القانوني الجزائري لعقود الدولة محورا لدراسة هذه العلاقة التي تعبر عن تأثير النقائص التي تعرفها تشريعات عقود الدولة على التنمية وترشيد انفاق المال العمومي. كلمات مفتاحية: تشريعات.، عقود الدولة.، الحوكمة المالية.، التنمية.، التجربة الجزائرية Abstract: The contract is a main tool for the state and its various units for the establishment, management and exploitation of public utilities, the latter has to keep pace with the development of those needs due to the development of lifestyles and the increase in the population as well, therefore, the legal framework that governs state contracts is an essential and pivotal part in the framework of good financial management of these facilities and work on their continuous development to the extent commensurate with the size of the development of society in its population and changing its needs imposed by the developments of human society in its various dimensions. The Algerian experience in this field can be taken as a model to determine the size of the direct relationship between the quality of legislation and regulations that govern state contracts and governance in the financial and development field. For this reason, the Algerian legal system for state contracts will be a focus for studying this relationship, which expresses the impact of the shortcomings known to legislation State contracts on development and rationalization of public money spending.
