الملخص
تهدف دراسة هذا المقال إلى تسليط الضوء على الدور الذي تلعبه اللجنة الإدارية المتساوية الأعضاء باعتبارها هيئة استشارية تتشكل من طرفين هما، الموظفون والإدارة بعدد متساوٍ، الغرض منها إشراك الموظف في تسيير حياته المهنية، وحسن تطبيق النصوص القانونية،كما ترمي أيضا إلى التعرّف على خصوصية الإطار الهيكلي والوظيفي للجنة خاصة بعد صدور المرسوم التنفيذي 20-199 المتعلق باللجان الإدارية المتساوية الأعضاء، ولجان الطعن واللجان التقنية في المؤسسات والإدارات العمومية. يعدُّ إنشاء اللجنة الإدارية المتساوية الأعضاء أكبر ضمانة للموظفين من تعسف الإدارة المستخدمة، إذ تساهم في ترسيخ أسس التشاور معها، وكذا توفير كافة الضمانات اللازمة لاحترام مبادئ العدالة والمشروعية والمساواة، وتوفير الاستقرار والأمان للموظفين في حياتهم المهنية. The study of this article aims to shed light on the role that the equal member administrative committee plays as an advisory body consisting of two parties, namely, employees and management in equal numbers, the purpose of which is to involve the employee in the conduct of his career and the proper application of legal texts. It also aims to identify the privacy of the framework. The structure and functionality of a special committee after the issuance of Executive Decree 20-199 related to equal member administrative committees, appeal committees and technical committees in public institutions and departments. The establishment of an equal member administrative committee is the biggest guarantee for employees against the arbitrariness of the used administration, as it contributes to establishing the foundations for consultation with it, as well as providing all necessary guarantees to respect the principles of justice, legitimacy and equality, and to provide stability and safety for employees in their professional lives
