الملخص
نتناول في هذه الدراسة الوضعيات القانونية الأساسية للموظف العام، وذلك بتسليط الضوء على ما جاء به المرسوم التنفيذي رقم 20-373 المتعلق بالوضعيات القانونية الأساسية للموظف في هذا الشأن. محاولين قراءة وتحليل مواد هذا المرسوم. الذي جاء تطبيقا للأمر رقم 06-03 المتضمن القانون الأساسي للوظيفة العمومية، وساعيا لضبط الأحكام والقواعد المتعلقة بالوضعيات القانونية الأساسية للموظف، التي تعد احدى المسائل الهامة في مسار الحياة المهنية للموظف. توصلنا إلى أن مواد هذا المرسوم حملت في طياتها عدة نقاط تخص نطاق وضوابط الوضعيات القانونية الأساسية للموظف، والتي تباينت بين وضعيات تظل فيها صلة الموظف بإدارته قائمة، كما هو الحال في القيام بالخدمة، وضعية الانتداب، وضعية خارج الاطار. ووضعيات أخرى تنقطع فيها العلاقة الوظيفية بشكل مؤقت والتي تظهر في وضعية الاستيداع، ووضعية الخدمة الوطنية. In this study, we deal with the basic legal situations of the public servant, by shedding light on what was stated by Executive Decree No. 20- 373 regarding the basic legal positions of the employee in this regard. We try to read and analyze the articles of this decree. Which came in implementation of Order No. 03-06 containing the basic law of the public office, and seeking to control the provisions and rules related to the .basic legal positions of the employee, which is one of the important issues in the career path of the employee We concluded that the articles of this decree contained several points related to the scope and controls of the basic legal positions of the employee, which varied between situations in which the employee's relationship with his management remains in place, as is the case in service performance, assignment status, and a situation outside the framework. And other situations in which the employment relationship is .temporarily interrupted, which appears in the status of deposit, and the status of national service
