الملخص
ملخص: إذا كان الهدف الأساسي من إنشاء المحكمة الجنائية الدولية يتمثل في ملاحقة ومعاقبة الجناة مرتكبي الجرائم الدولية الخطيرة، فان نظامها الأساسي لم يهمل حقوق ضحايا هذه الجرائم، من خلال نصه على قواعد لحمايتهم حتى يتسنى لهم المشاركة الفعلية في الإجراءات، الذي يكون الهدف منه غالبا طلب التعويض المنصف عن الأضرار المادية والمعنوية التي أصابتهم. ليشكل بذلك اهتمام المحكمة الجنائية بضحايا الجرائم الدولية أول تجربة للعدالة الجنائية الدولية، التي أرست إلى جانب منع الإفلات من العقاب، تكريس حق الضحايا في جبر أضرارهم عن طريق تعويضهم عما يكون قد لحقهم من ضرر جراء الفعل المجرم المرتكب ضدهم، لذلك يكتسي البحث في هذا الموضوع أهمية فائقة، نظرا للدور الذي يمكن أن يلعبه تعويض الضحايا في إرساء أسس العدالة الجنائية الدولية. بناء عليه تهدف هذه الورقة البحثية إلى محاولة إلقاء الضوء على الجهود المبذولة من طرف المحكمة الجنائية الدولية لتعويض ضحايا الجرائم الدولية الخطيرة، من خلال توضيح إجراءات طلب التعويض أمام المحكمة الجنائية الدولية والوقوف على نماذج عملية للتعويض. الكلمات المفتاحية: الجرائم الدولية الخطيرة، التعويض، الضحايا، المحكمة الجنائية الدولية. Abstract: If the primary objective of establishing the International Criminal Court was to prosecute and punish the perpetrators of serious international crimes, its statute did not neglect the rights of victims of these crimes, by stipulating rules to protect them so that they could participate effectively in the procedures, the aim of which is often to seek fair compensation for the material and moral damages they have suffered. Thus, the criminal court’s interest in victims of international crimes constituted the first experience of international criminal justice, which was established in addition to preventing impunity, establishing the right of victims to obtain reparation for their damages by compensating them for the harm they may have suffered as a result of the criminal act committed against them, therefore, the research on this issue is of paramount importance, given the role that compensation for victims can play in laying the foundations of international criminal justice. Accordingly, this research paper aims to attempt to shed light on the efforts made by the International Criminal Court to compensate victims of serious international crimes, by clarifying the procedures for seeking compensation before the International Criminal Court and on practical models for compensation.
