الملخص
ملخص: تهدف هذه الدراسة إلى تسليط الضوء على اللجان الانتخابية أثناء الانتخابات المحلية( البلدية، الولائية) وعلى هذا الأساس تنبع أهمية الموضوع كونه يسلط الضوء على تشكيلة، وصلاحيات اللجان الانتخابية في الانتخابات المحلية في إدارة المرحلة النهائية من العملية الانتخابية بعد تكليف السلطة الوطنية المستقلة للانتخابات بإدارة وتنظيم والإشراف والرقابة على الانتخابات والاستفتاءات. وقد توصلنا إلى النتائج التالية: إبعاد الإدارة كليا عن إدارة العملية الانتخابية وإسنادها إلى السلطة الوطنية المستقلة للانتخابات التي دعمت بصلاحيات واسعة مع امتداد تواجدها محليا، الإشراف القضائي على الانتخابات المحلية من خلال ترؤس القضاة لمختلف للجان منها اللجان الانتخابية البلدية والولائية يقلل من حجم المنازعات الإنتخابية ويضفي عليها القبول من طرف الجميع لحياد القضاء واستقلاليته ومنه تحقق النزاهة والشفافية المطلوبتين، لكن قرارات هذه اللجان تبقى خاضعة لرقابة القضاء الإداري على درجتين، إعلان النتائج النهائية للانتخابات المحلية أصبح من إختصاص السلطة المستقلة، صلاحيات اللجنة الانتخابية الولائية تتطلب التوضيح بخصوص صلاحية المعاينة التي لم تدرج في نص المادة 185 من الامر رقم 21-01، بينما أدرجت في نص المادة 268 من ذات الأمر دون تحديد الإجراء الواجب اتخاذه بعد المعاينة. Abstract: This study aims to shed light on the electoral committees during the local elections (municipal, willaya), and on this basis stems the importance of the topic as it sheds light on the composition and powers of the electoral committees in the local elections in managing the final stage of the electoral process after assigning the Independent National Authority for Elections to manage and organize Supervision and control of elections and referendums. We have reached the following results: removing the administration completely from managing the electoral process and assigning it to the Independent National Election Authority, which supported it with wide powers with its presence locally, judicial supervision of local elections through judges chairing various committees, including municipal and state electoral committees, reduces the volume of disputes The electoral commission is accepted by all for the impartiality and independence of the judiciary, thus achieving the required integrity and transparency, but the decisions of these committees remain subject to the control of the administrative judiciary at two levels. Announcing the final results of the local elections has become the prerogative of the Independent National Electoral Authority, The powers of the State Electoral Commission require clarification regarding the inspection authority, which was not included in the text of Article 185 of Ordinance No. 21-01, while it was included in the text of Article 268 of the same order without specifying the procedure to be taken after the inspection.
