حالة دفع مسؤولية المنتج المبني على خطأ المستهلك المضرور

الملخص
لقد صارت مسؤولية المنتج تمثل تطورا جديدا وتوسعا عميقا في المسؤولية المدنية باعتبارها تجسد فرعا حديثا من فروعها، وأيضا بالنظر إلى ما صارت تسببه بعض المنتجات من أضرار كارثية على صحة ومصلحة المستهلكين، بحيث يكون المصنع أو المنتج مجبرا على تعويضهم عن الأضرار التي لحقت بهم وفقا للقواعد العامة المنصوص عليها قانونا. لكن بالمقابل، يستطيع المنتج التخلص من المسؤولية المدنية القائمة في جانبه متى استطاع إثبات أن الضرر كان نتيجة لخطأ المستهلك المضرور، وذلك إما بسبب استعماله الخاطئ للمنتجات أو استعماله للمنتج بعد انقضاء تاريخ مدة صلاحيته، أو استطاع أن يبثث أن تفاقم الضرر كان بمساهمة المستهلك المضرور أيضا.
