دور القانون الدولي في نشر قيم التسامح ومكافحة التحريض على الكراهية الدينية

الملخص
تهدف هذه الدراسة إلى تسليط الضوء على ظاهرة الإساءة إلى الأديان وبيان علاقتها بالقانون الدولي، من خلال التعرف على الأسس والقواعد القانونية التي تقوم عليها فكرة التسامح الديني، ومتطلبات الوقاية من خطاب الكراهية الدينية، فإذا كانت قواعد القانون الدولي الأولى قد أرست أسسا للنظام الدولي المبني على ضرورة احترام الاختلاف الديني، فإن بعض مظاهر عدم التسامح الديني ظلت قائمة في العالم بسبب عدم احترام ديانات الأقليات داخل الدول التي يدين بعض سكانها بدين غير دين الأغلبية فيها. لذلك ومنذ نشأة الأمم المتحدة اتسع مجال الاهتمام بحقوق الإنسان وحرياته، ومن ضمنها حقوقه الدينية، وهكذا فبقدر ما أكدت وشددت النقاشات آنذاك، عند صياغة الوثائق الدولية الخاصة بحقوق الإنسان، وبالخصوص وثائق الشرعية الدولية، على حرية الإعلام وحرية الرأي والتعبير، بقدر ما نصت بوضوح على الحرية الدينية. Abstract: This study aims to highlight the phenomenon of religious abuse and demonstrate its relationship to international law, by defining the legal foundations and standards underlying the idea of religious tolerance and the requirements for preventing religious hate speech. If the first rules of international law lay the foundations of the international system on the basis of the need to respect religious differences, some manifestations of religious intolerance persist in the world because of the lack of respect for minority religions that owe a religion other than that of the majority of State citizens. Therefore, interest in human rights and freedoms, including their religious rights, has expanded since the establishment of the United Nations, with discussions that, in the drafting of international human rights documents, particularly documents of international legitimacy, freedom of information and freedom of opinion and expression, have emphasized the need to ensure religious freedom.
