مقاصد مستثنيات القواعد الفقهية الكلية عند الحنفية دراسة تطبيقية

الملخص
يأتي هذا البحث لدراسة مستثنيات القواعد الفقهية الكلية في المذهب الحنفي وذكر مقاصدها؛ مساهمة من الباحثة في الدراسات الأصولية والفقهية، وقد جعلت عنوانه «مستثنيات القواعد الفقهية الكلية في المذهب الحنفي ومقاصدها- دراسة تطبيقية»، وقد تناولته في مقدمة وثلاثة مباحث وخاتمة. فالمقدمة ذكرت فيها أهمية البحث ومشكلته وأهدافه والدراسات السابقة عليه ومنهجه وإجراءاته وخطته، بينما تناولت في المبحث الأول المستثنيات التي تندرج تحت فروع قاعدة الأمور بمقاصدها ومقاصد تلك المستثنيات، وتناولت فيها قاعدتين جزئيتين فرعيتين عن هذه القاعدة الكلية، وفي المبحث الثاني تناولت المستثنيات التي تندرج تحت فروع قاعدة الضرر يزال ومقاصدها ومقاصد تلك المستثنيات، وتناولت فيها أيضا مستثنيات قاعدتين فرعيتين عن هذه القاعدة الكلية، وتناولت في المبحث الثالث المستثنيات التي تندرج تحت القاعدة الكلية اليقين لا يزول بالشك ومقاصدها، وتناولت فيها مستثنيات سبع قواعد جزئية تتفرع عن هذه القاعدة الكلية ومقاصد تلك المستثنيات. ثم ختمت البحث بخاتمة بينت فيها أهم النتائج التي برزت من خلال دراسة المستثنيات، وقد ظهر فيها قيمة دراسة القواعد الفقهية وتطبيقاتها ومستثنياتها في تخريج الفروع الفقهية على الأصول المذهبية، ثم ذكرت بعض التوصيات التي تثري البحث العلمي وتساهم في خدمة الباحثين والمتعلمين والمهتمين بدراسة الفقه الإسلامي وأصوله المختلفة. Abstract: This research comes to study the exceptions to the total jurisprudence rules in the Hanafi school and mention their purposes. A contribution from the researcher in fundamentalist and jurisprudential studies, and she made its title “Exclusions of the total jurisprudential rules in the Hanafi school and its purposes - an applied study”, and I dealt with it in an introduction, three sections and a conclusion. The introduction mentioned the importance of the research, its problem, its objectives, previous studies, its method, procedures and plan, while in the first section it dealt with the exceptions that fall under the branches of the rule of affairs with their purposes and purposes of those exceptions. The rule of harm still and its purposes and purposes of those exceptions, and also dealt with the exceptions of two sub-rules of this universal rule, and dealt in the third section the exceptions that fall under the rule of the total certainty is not removed by doubt and their purposes, and dealt with the exceptions of seven partial rules branching from this universal rule and the purposes of those exceptions. Then she concluded the research with a conclusion showing the most important results that emerged through the study of exceptions, and the value of studying jurisprudential rules, their applications and exceptions appeared in the graduation of jurisprudence branches on doctrinal assets, and then mentioned some recommendations that enrich scientific research and contribute to the service of researchers, learners and those interested in studying Islamic jurisprudence and its foundations. different.
