إشكالية التنازع المتحرك في العلاقات الخاصة الدولية

الملخص
تعد العلاقات الخاصة الدولية المجال الخصب لتنازع القوانين و التي يثور بشأنها مشكل التنازع المتغير، الذي يعتبر من المسائل الدقيقة المتعلقة بتطبيق قواعد التنازع و توزيع الاختصاص بين القوانين المتنازعة، إلا أن التغيرات التي تطرأ على ضوابط الإسناد من شأنه أن ينقل العلاقات القانونية المشوبة بعنصر أجنبي من نطاق قانوني إلى آخر. من أجل ذلك تكفل الفقه والتشريع بإيجاد بعض الحلول لهذه المشكلة، في مساهمة منهما لتذليل الصعوبات و العقبات التي يمكن أن تعترض سيرورة وديمومة هذه العلاقات خاصة في مسائل الأحوال الشخصية. International private relations are the fertile field for conflict of laws, in which the problem of changing conflict arises, Which is considered one of the delicate issues related to the application of the rules of conflict and the distribution of jurisdiction between conflicting law, However, changes in the attribution controls would transfer legal relations tainted with a foreign element from one legal domain to another. For this reason, jurisprudence and legislation ensure that some solutions to this problem are found, In their contribution to overcoming the difficulties and obstacles that may hinder the process and continuity of these relations, especially in matters of personal status.
