النظام العربي لضمان الاستثمارات ضد المخاطر غير التجارية ( The Arab System For Guaranteeing Investments Against Non-commercial Risks)

الملخص
المؤسَّسةُ العربية لضمانِ الاستثمارِ وائتمانِ الصّادرات ((ضَمان)) هي مؤسَّسةٌ عربيةٌ إقليمية، ذاتُ كيانٍ قانونيٍّ مستقِلّ، متعدِّدةُ الأطراف، تُقدِّمُ خدماتِ ضمانٍ ضِدّ المخاطرِ التّجاريةِ والسّياسية على مدى 47 عامًا الماضية. تأسّست المؤسَّسة عام 1974 في الكويت، كأوّلِ هيئةٍ متعدِّدةِ الأطراف لضمانِ الاستثمارِ في العالم، وهي مملوكةٌ لِحكوماتِ إحدى وعشرينَ(21) دولةً عربية وأربعِ (4) هيئاتٍ ماليةٍ عربيّة. لتجسيدِ ذلك، قامت المؤسَّسةُ بإبرامِ عقدِ ضمانِ الاستثمار، حيث تلتزمُ بموجِبِه بتعويضِ المُستثمِرِ المؤمَّنِ عن الأخطارِ غيرِ التّجارية والتي قد تصيبُ مشروعَه الاستثماري.ويُعتبرُ عقدُ الضّمانِ العربي وسيلةً قانونيةً هامّة لمواجهةِ المخاطرِ غيرِ التّجارية التي تواجهُ المستثمرَ العربي، والمتمثّلةِ في الأخطار السّياسيةِ التّالية: التّأميم، المصادَرة، الاستيلاء،الحِراسة وتأجيل الوفاءِ بالدّيون، بالإضافةِ إلى الأخطارِ النّاجمةِ عن قيودِ تحويلِ العُملة، والحروبِ والفِتنِ الدّاخلية. The Arab Investment & Export Credit Guarantee Corporation (Dhaman) is an autonomous Arab regional multilateral development organization that has provided guarantee services against commercial and political risks for the last 47 years. Established in 1974 in Kuwait as the first multilateral investment guarantee provider in the world, Dhaman is owned by the governments of 21 Arab States and 4 Arab financial institutions. The Arab Investment Guarantee Corporation, and to achieve this, the Corporation has taken out the investment guarantee contract into existence, whereby it undertakes to compensate the secured investor for the non-commercial risks that may affect his investment project. The holding of the Arab security important legal means to address the non-commercial risks facing the Arab investor, represented in political risks: the nationalization, confiscation, seizure, guarding the postponement of debt, in addition to the dangers of currency restrictions, wars, internal sedition.
