آليات المحافظة على النظام العام البيئي في التشريع الجزائري

الملخص

إن الحفاظ على البيئة ومكوناتها يقتضي تدخل الدولة لضبط الأنشطة المسببة للتلوث باعتبارها تشكل تهديداً للنظام العام، هذا الأخير يتغير مضمونه حسب احتياجات المجتمع ممّا جعل فكرة النظام العام البيئي تمثل أحد مظاهر المفهوم الحديث للنظام العام. وفي سبيل المحافظة على النظام العام البيئي تبني المشرع الجزائري منظومة قانونية تتضمن مجموعة من الآليات والوسائل المقرّرة لصالح هـيئات الضبط الإداري البــيئي، بدءاً من نظام الترخيص، الذي يعدّ من بين أكثر الوسائل فاعـلية وتحكماً في حماية النظام العام البيئي، إضافة إلى وسائل أخرى لا تقل أهمية عن سابقتها كنظام الحظر والإلزام، ودراسة التأثير والخطر على البيئة، كل هذا في إطار ما يعرف بالوسائل القانونية ذات الطبيعة الوقائية. كما نجد أن المشرع قد منح هيئات الضبط الإداري البيئي وسائل قانونية ذات طبيعة علاجية في حالة الاخلال بالنظام العام البيئي، والمتمثلة أساساً في كل من نظام الإعذار ووقف النشاط، وكذا سحب الترخيص، وأخيراً الجباية البيئية. Abstract: Preserving the environment and its components requires the intervention of the state to control the pollution-causing activities as they constitute a threat to the public order. In order to preserve the environmental public order, the Algerian legislator has adopted a legal system that includes a set of mechanisms and means for the benefit of the environmental administrative control bodies, starting with the licensing system, which is among the most effective and controlling means of protecting the environmental public order, in addition to other no less important means. From its predecessor, such as the prohibition and obligation system, and the study of the impact and danger on the environment, all this within the framework of what is known as legal means of a preventive nature. We also find that the legislator has granted the environmental administrative control bodies legal means of a remedial nature in the event of a breach of the environmental public order, which is mainly represented in the system of excuses and suspension of activity, as well as the withdrawal of the license, and finally environmental collection.
