نسب ولد الزنا في ضوء الشريعة الإسلامية ،صوره و أحكامه .

الملخص
-يسعى هذا البحث لتجلية مسائل مهمّة في ضوء الشريعة الإسلامية ، كما يحاول الإجابة على قضيّة مهمّة إشكاليتها: هل الزّنا يصلح أن يكون سببا لثبوت النّسب أم لا؟ . وقد أولت الشريعة اهتماما بكليّة النّسب ،ولهذا شرّعت أحكاما تحتاط للأنساب وتصونها، من ذلك مسألة نسب ولد الزنا ولهذه المسألة صور ، فأمّا نسب ولد الزّنا من الأمّ فيلحق بها اتّفاقا ،وأمّا نسب ولـــد الزّنا من جهة الأب ، فهذه المسألة لها صورتان ، الأولى: نسب ولد الزّنا باستلحاق الزّاني مع وجود الفراش، وهنا يلحق بالأب صاحب الفراش مع إقراره ، وأمّا إذا أنكره صاحب الفراش فلا يلحق به اتّفاقا ، وأمّا إذا كانت الأمّ غير فراش ، فإمّا : أن لا يستلحقه الزّاني ، فهنا لا يلحق به ،وأمّا عند استلحاق الزّاني للولد : فهذه المسألة اختلف العلماء فيها على قولين ، قول أنّه يلحق به ، وقول أنّه لايلحق بالزاني ، وهو الراجح من الأقوال ،وبهذا يتبين أنّ الشريعة لم تعتبر الزّنا في كافة مناحي الحياة ومنها سببية إثبات النّسب ، وذلك قطعا لفساده ،وإلغاء لشرعيته . This research seeks to clarify important issues in the light of Islamic law, as it tries to answer the following problem: Is adultery a reason for establishing lineage or not? The Sharia has paid close attention to the totality of lineage, and for this, it has enacted provisions that protect and preserve ineages. Some of these provisions are in regard to the issue of the lineage of the child of adultery, which has two forms: As for the lineage of the child of adultery from the mother, it is annexed by consensus, and as for the lineage of the child of adultery from the father’s side, this issue has another two forms. The first: Attribution of the child of adultery to the adulterer joining the adulterer with the presence of the mattress, and here he is attached to the father who owns the bed with his approval, and if the bed-owner denies him, he is not annexed to him by agreement. But if the mother is not a mattress, either: that the adulterer does not annex the child to him, here he is not annexed, or when the adulterer annexes the boy, then this issue is disputed by scholars on two views. The first view says that he is annexed, and the second says that he is not. The latter is the most correct of the two sayings.
