أثر فقه الموازنات في اعتبار الكفاءة أو إلغائها

الملخص
حالات كثيرة من الشقاق الزوجي والتشرّد الأسري سببها عدم الكفاءة في الزواخ، لذلك وضع الإسلام أسسًا دقيقة ينبغي مراعاتها. من بين هذه الأسس التقارب بين الزوجين في العناصر الدينية والاجتماعيّة والأخلاقيّة والثقافيّة، وما مراعاة هذه الضوابط والأسس، إلاّ لتفادي المشاكل الأسرية، وخلق الاستقرار والانسجام بين الزوجين، ونظرًا للاختلاف الحاصل بين الفقهاء قديما وحديثا في هاته الضوابط، تناول المقال دور فقه الموازنات في ضبط وتحديد الحكم المناسب من خلال عرض المصالح والمفاسد المتعارضة في المسألة، ومن ثمّ تحديد الحكم الذي يراعي مقصد الشارع وفقه الواقع. Abstract: Many situations of marital discord and family homelessness caused by incompetence in marriage, the reason why Islam put precise foundations, which should to be taken in consideration.Among these foundations, the rapprochement between spouses in religious, social, ethical and cultural elements were made to avoid family problems and to create stability and harmony between spouses. Dueto the difference between ancient and modern jurists in considering these controls, thispaper, discuss the role of jurisprudence equilibriums in controlling and determining the appropriate judgment by presenting interests and contradictory maleficence in the subject, then defining the provision that takes into account the intent of the street and the jurisprudence of reality.
