القوة الثبوتية لمصادر حق الأفضلية في التشريع الجزائري

الملخص
إن خصوصية حق الأفضلية لا تكمن في كونه تحصيل حاصل لـتأمين من التأمينات العينية فحسب، بل مردها إعتبار الأولوية محورا تدور حوله فكرة الضمان الخاص لما يوفره من ائتمان يفتقده الدائنون في الضمان العام ،فنجد ضمن مصادر حق الأفضلية ما هو تصرف قانوني قائم على الإرادة كالرهن الرسمي، ومنها ما ينسب للنص القانوني في صورة حقوق الامتياز،وعليه يكون إثبات مصادر حقوق الأفضلية خطوة إستباقية تحسبا لمرحلة النزاع القضائي. حيث تهدف هذه الدراسة إلى قياس القوة الثبوتية لمصادر حق الأفضلية بين الإطلاق والنسبية و تأثيرها في استيفاء الدائن الممتاز لحقوقه بالأولوية على غيره من الدائنين ، ولعل من أبرز النتائج التي يمكن الخروج بها من هذه الدراسة هي أن دور المتمسك بمصادر حق الأفضلية يتأرجح في خصومة الإثبات بتأرجح موقعه من عبء الإثبات بين مدعي ومدعى عليه ليكون في حالات ملزما بتقديم الدليل كما في حالة عقد الرهن الرسمي والرهن الحيازي ، غير أنه في حالات أخرى تعفيه القرائن القانونية من أي إثبات كصورة حقوق الامتياز.
