أحكام الوكالة من الباطن -ماهيتها و آثارها-

الملخص
الأصل في الوكالة أنه لا يجوز للوكيل إنابة غيره فيما وكل بتنفيذه وإلا كان متجاوزا لحدودها ،كونها من العقود التي يراعى فيها الإعتبار الشخصي خاصة للوكيل ؛لكن مع التطور الإجتماعي و الإقتصادي و التكنولوجي إزدادت حاجات الأفراد مما أدى بالوكيل اللجوء إلى إنابة غيره لتنفيذ ماوكل به،و أصبح هذا النوع من التعاقد من أكثر الأساليب مواكبة للتطور العلمي والعملي، ونهدف من خلال دراستنا تسليط الضوء على مدى شرعية الوكالة من الباطن و توضيح العلاقات التي تربط أطراف الوكالة و الإنابة بعضهم ببعض من موكل و وكيل أصلي و نائب وكيل عند تنفيذ هذا الأخير لمهمته في حدودها المرسومة . و بالرغم من تشعب العلاقات بين الأطراف الفاعلين و عدم كفاية نص المادة 580 من القانون المدني الجزائري ؛ إلا أن المشرع الجزائري وفق عندما جعل الدعوى المباشرة حق لكل من الموكل و نائب الوكيل فهي ضمانة تكفل العلاقات وتحقق الهدف المنشود المتمثل في إستقرار المعاملات . Abstract: The basic principal In the agency is that the agent is not permitted to delegate to someone else what he was entrusted with its implementation, otherwise it would exceed its limits, since it is one of the contracts in which personal consideration is taken into account, especially for the agent, but with the social, economic and technological development, the needs of individuals increased, which led the agent to resort to delegating others to implement what he was entrusted with, and this type of contracting has become one of the most consistent methods of scientific and practical development, and we aim through our study to shed light on the legitimacy of the sub-agency and to clarify the relationships that bind the parties to the agency and proxy each other, including a principal, an original agent, and a deputy agent when the latter performs his mission within its drawn boundaries. And despite the complexity of relations between the actors and the inadeputy of the text of Article 580 of the Algerian Civil Code ;However, the Algerian legislator, according to when he made the direct lawsuit a right for both the principal and the deputy agent, it is guarantee that guarantees relations and increases the stability of transactions , which is the desired goal.
