الملخص
ملخص: يعتبر موضوع السكن من القضايا المهمة التي تستدعي الاهتمام والعناية، فالسكن من الحاجيات الضرورية للإنسان التي تضمن له كرامته في أي مجتمع كان، وهو من الحقوق المكفولة دستوريا، ومن أجل القيام ببناء سكن يجب الالتزام بمجموعة من الشروط التي تضمن الحفاظ على الأمن والسلامة والوقاية من الحوادث، بالإضافة إلى الحفاظ على البيئة، وهذا لا يتأتى إلا بالالتزام بالقواعد المتعلقة بالتهيئة والتعمير التي نص عليها المشرع الجزائري والمتمثلة خاصة في عقود التعمير، ومن بينها رخصة البناء التي تعتبر آلية قانونية هامة لتفعيل عملية الرقابة على العمران. وعليه، فإن هذه الدراسة استهدفت البحث عن رخصة البناء باعتبارها أداة قانونية لها دور رقابي ووقائي على أشغال البناء والتعمير يهدف لمحاربة كل توسع عمراني غير منظم، وقد نظم المشرع الجزائري هذه الرخصة بموجب القانون 90/29 المؤرخ في 12/02/1990، والمتعلق بالتهيئة والتعمير المعدل والمتمم، وكذا المرسوم التنفيذي 15/19 المؤرخ في 25/01/2015 المحدد لكيفيات تحضير عقود التعمير وتسليمها، المعدل والمتمم بالمرسوم التنفيذي 20/342 المؤرخ في 22 نوفمبر 2020 . The issue of housing is considered one of the important issues that require attention and care, because housing is one of the essential needs of a person that guarantees his dignity in any society, and it is one of the rights guaranteed by the constitution, and in order to build housing, a set of conditions must be adhered to that ensure the preservation of security and safety and the prevention of accidents In addition to preserving the environment, this can only be achieved by adhering to the rules related to preparation and reconstruction stipulated by the Algerian legislature, namely, reconstruction contracts, including the building permit, which is an important legal mechanism to activate the process of oversight over construction. Accordingly, this study aimed to search for a building permit as it is a legal tool that has a supervisory and preventive role on building and reconstruction works, aiming to combat all unregulated urban expansion, which was organized by the Algerian legislator under Law 29/90 dated 02/12/1990 related to the preparation and amended reconstruction And the supplement, as well as Executive Decree 19/15 of 01/25/2015 specifying the modalities for preparing and delivering construction contracts, amended supplemented by executive decree 20/342 of November 22,2020 .
