الملخص
ملخص: التحويلات المصرفية من أهم المعاملات المالية المعاصرة أكثرها شيوعا بين الناس، لشدة الحاجة إليها. فما حقيقة التحويلات المصرفية؟ ما وصفها وتكييفها الشرعي؟ ما الحكم الشرعي لما يؤخذ عليها ؟ ذلك هو ما حاولت أن أجيب عليه في هذا البحث. وقسمت البحث إلى مقدمة، وتمهيد، وثلاثة مطالب، وخاتمة. المقدمة: تتضمن تمهيدا موجزا عن أهمية الموضوع، ثم خطة البحث. التمهيد: يتضمن تصوير المسألة؛ لأن الحكم على الشيء فرع عن تصوره. والمطلب الأول لمناقشة من ذهبوا إلى تكييف التحويلات المصرفية على أساس أنها إجارة على نقل النقود وبينت ضعف مستندهم. والمطلب الثاني لمناقشة من كيفها على أساس أنه وكالة؛ وبينت ضعف ما استندوا إليه. والمطلب الثالث فاستعرضت فيه حجج من كيفها على أساس أنها سفتجة؛ وبينت أن رأيهم هو الراجح، وأجبت على أهم ما اعترض به عليهم، ولم ألتفت لبقية التخريجات لشدة ضفها. الخاتمة: تتضمن خلاصة ما توصل إليه الباحث Abstract: Bank transfers are one of the most important contemporary financial transactions and the most common among people, due to the great need for them. What is the truth about bank transfers? What is her description and legitimate adaptation? What is the legal ruling for what is taken on it? That is what I have tried to answer in this paper. The research was divided into an introduction, an introduction, three demands, and a conclusion. Introduction: Includes a brief introduction to the importance of the topic, and then a research plan. Preface: includes depicting the issue; Because judging a thing branch from its perception. The first requirement to discuss with those who went to the adaptation of bank transfers on the basis that it is a rent to transfer money and showed the weakness of their document. The second requirement is to discuss how it is based on agency; And it showed double what they relied on. And the third requirement, in which arguments were presented, on the basis that they are presumptuous. And she indicated that their opinion is the most correct, and I answered the most important thing that was objected to them, and I did not pay attention to the rest of the graduations because of the severity of it. Conclusion: It includes a summary of the researcher's findings .
