الملخص
تناولت الدراسة المبادئ والقواعد التي جاء بها التشريع الإسلامي فيما يتصل بأخلاقيات الحرب وضوابطها، من خلال تسليط الضوء على الإسهامات الحضارية الجليلة لأعمال ووصايا الخلفاء الراشدين في أَنّْسَنةْ الحروب وخلقنتها باعتبارها مصدرا من مصادر التشريع الدولي. وأكدت الدراسة أن هذه الوصايا والتعليمات الصادرة لأمراء الجيوش وقادة الأقاليم، والمضبوطة بالأصول القرآنية والسنن النبوية، غايتها حفظ كرامة الإنسان واحترام إنسانيته، وهي مشتملة على كافة الأحكام والضوابط الخاصة بالقتال، وبمعاملة أسرى وجرحى الحرب. The study dealt with the principles and rules of Islamic legislation in relation to the ethics of war and its regulations, by shedding light on the great civilizational contributions of the actions and commandments of the Rightly Guided Caliphs in humanizing wars and making them more ethical as a source of international legislation. The study emphasized that these commandments and instructions, issued to the emirs of armies and commanders of the provinces, are regulated by the Quranic origins and the Prophet’s Sunnah, and their goals are to preserve human dignity and respect his humanity, and it included all the rules and regulations related to combat, and the treatment of prisoners and wounded of war.
