الملخص

يتناول هذا المقال الطبيعة القانونية لما ينشر عبر مواقع التواصل الاجتماعي خصوصا الفيسبوك والانستغرام وأهلية هذه المنشورات للحماية، بمعنى هل تخضع للحماية القانونية المقررة للمصنفات التقليدية أم لا؟ بهدف تسليط الضوء على هذا الإشكال اتبعنا المنهج التحليلي في مقالنا؛ ليتضح أنها فعلا تتمتع بالحماية إذا ما توافرت فيها الشروط اللازمة، غير أن الإشكال يكمن في المنصات التي تنشر عبرها (مواقع التواصل الاجتماعي )التي تحول دون تتمة ذلك، نظرا لفرضها ترخيص على المنتسبين إليها يجيز لها التصرف في ما ينشر عبرها. و تم التوصل إلى النتائج التالية: - المؤلَّفات المنشورة عبر مواقع التواصل الاجتماعي شأنها شأن المؤلَّفات التقليدية تخضع للحماية القانونية إذا ما توافرت فيها الشروط المقررة . - يعتبر المؤلِف مالكا لما ينشره على هذه المواقع يحق له المطالبة بحقوقه في حالة وقوع أي انتهاك من قبل الغير دون إدارة المواقع. - النشر عبر مواقع التواصل الاجتماعي يعفي هذه المنصات من المسؤولية الناجمة عن أي انتهاك واقع على المؤلفات نظرا لترخيص المؤلف باستعمال ما ينشره كشرط للولوج إلى هذه المواقع. This article deals with the legal nature of what is posted on social media sites, especially Facebook and Instagram, and the eligibility of these ?publications for protection, meaning whether they are subject to the legal protection prescribed for traditional works or not In order to shed light on this problem , we followed the analytical method in this article, so that it becomes clear that it is indeed protected if the necessary conditions are met, but the problem lies in the platforms through which they are published (social media sites) that prevent the . continuation of this, as they impose a license on their affiliates that allows them to act in what is published through them : The following results were reached Works published on social media, as well as traditional ones, are subject to legal protection if formal and objective conditions are me - The author is considered the owner of what he publishes on these sites and is entitled to claim his rights in the event of any violation by others .without managing the site Posting on social media relieves these platforms of responsibility resulting from any violation of the literature due to the author's license to use .what he publishes as a condition for access to these site
