الملخص
الملخص : نتيجة للتطور التكنولوجي الذي فرض نفسه على كافة الميادين الحياتية والإنسانية، فإننا أصبحنا نرى صداه في القطاع المصرفي الذي بات يعتمد في تعاملاته على الخدمات المصرفية الالكترونية لتسهيل خدمات الزبائن. ورغم الايجابيات المقترنة باستخدام الوسائل التكنولوجية في المهنة المصرفية إلاّ أنها تمس بمصداقيتها، خاصة في ظل الفراغ التشريعي نتيجة عدم تجاوب القانون ومسايرته التطور المستمر للتقنيات الحديثة. هذه الدراسة تهدف إلى تسليط الضوء على مكانة السرية المصرفية في ظل استعمال الخدمات المصرفية الالكترونية والحديثة ومدى تأثرها بها. Abstract: As a result of the technological development that imposed itself on all areas of life and humanity, we are seeing its echo in the banking sector, which has become dependent in its dealings on electronic banking services to facilitate customer services. Despite the advantages associated with the use of technological means in the banking profession, it undermines its credibility, especially in light of the legislative vacuum as a result of the law’s failure to respond and keep pace with the continuous development of modern technologies. This study aims to shed light on the status of banking secrecy in light of the use of electronic and modern banking services and the extent of their vulnerability to them.
