الملخص
الملخص: سعى المشرع الجزائري إلى اعتماد سياسة جديدة تحسن من طريقة تسيير عقد الامتياز المكرّس لخدمة القطاع الفلاحي خاصة بعد إثبات النصوص السابقة عدم فعاليتها في إبقاء السير الحسن للعقد، وعليه تدّخل المشرع بتنظيم هذا العقد مكرّسا ما يضمن استمرارية سيره وفق سياسة ناجحة بالنص على ضمانات مقررة للأطراف منها ما يتعلق بالحق ذاته ومنها ما يتعلق بالتزامات الأطراف، و من هذا المنطلق حاولنا من خلال هذه الدراسة تحديد هذه الضمانات التي جاء بها القانون 10/03 المحدد لشروط و كيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة Abstract The Algerian legislator has sought to adopt a new policy that improves the conduct of the concession contract devoted to the service of the agricultural sector especially after the previous texts have proved their ineffectiveness in maintaining the proper functioning of the contract therefore, the legislator intervened in organizing this contract, dedicating what would guarantee its continuity according to a successful policy by mentioning the guarantees established for the parties to the contract and it is linked to the right itself and among the guarantees are the obligations of the parties, , from this standpoint, we tried, through this study, to define the guarantees stipulated in Law 03/10 specifying the conditions and methods of using the state's private agricultural lands.
