الحماية القانونية للمعلومات والمعاملات الإلكترونية في التشريع الجزائري

الملخص
تهدف هذه الدراسة إلى الوقوف على كفاية القوانين الجزائرية لتأطير وتنظيم التعاملات الرقمية والتجارة الإلكترونية وقدرتها على حماية الأنظمة الآلية للمعلومات وتحديد مدى ملائمة التشريعات الجزائرية (فيما يخص التعاقد الإلكتروني، التوقيع الإلكتروني، التصديق الإلكتروني) وتماشيها مع توجه الخدمات الإلكترونية. توصلت الدراسة إلى وجود تدرج خلال النظام العقابي للنصوص المتعلقة بالجرائم الماسة بالأنظمة المعلوماتية تبعا للخطورة الإجرامية التي قدرها المشرع لهذه التصرفات، كما تناول المشرع الجزائري موضوع التعاقد الإلكتروني في إبرام الصفقات في الباب السادس بعنوان: الاتصال وتبادل المعلومات بالطريقة الإلكترونية. كما توصلت الدراسة إلى أن النصوص التي أصدرها في شأن المعاملات الإلكترونية تبقى غير كافية. Abstract The present study explores the adequacy of Algerian laws framing and regulating digital transactions and electronic commerce; and its ability to protecting electronic information systems. The study also aims to determine Algerian legislation appropriateness) Electronic contracting; electronic signature; Electronic certification) and its compatibility with electronic services and identification of Algerian legislative structure readiness for the organizations’ electronic transformation. The study resulted that there is a hierarchy within the texts’ penal system related to information systems’ crimes depending on criminal risk assessed by the legislator for these acts. The Algerian legislator also addressed the electronic contracting issue in concluding deals in Chapter VI entitled "Electronic communication and exchange of information". The study also found out that texts issued in the protection of information and electronic transactions remain insufficient.
