الأسرار التجارية وأثرها على نقل التكنولوجيا.

الملخص
تعد الأسرار التجارية جزء من نظام الملكية الفكرية ، وذلك لارتباطها بمسألة نقل التكنولوجيا ، والتي غالبا ما تكون محلا في عقود نقل التكنولوجيا ، ومن هنا تظهر العلاقة بين الموضوعين حيث تهدف هذه الدراسة إلى إبراز هذه العلاقة ونتائجها ، ونظرا لرغبة الدول النامية في الاندماج في الاقتصاد الدولي من خلال اكتساب ما تم التوصل اليه من تقدم وأسرار تكنولوجية بموجب عمليات نقل التكنولوجيا فإنها تعتبر الأسرار التجارية قيدا لنقل التكنولوجيا لكونها مكلفة بالنسبة لها ، إضافة إلى أن هذا النظام يؤدي إلى الإبقاء على الكثير من المعلومات سرية لمدة طويلة مما يحرم المجتمع من الاستفادة منها على خلاف الافصاح الذي يعتبر هدف للارتقاء التكنولوجي، وعلى النقيض من ذلك تعتبر الدول المتقدمة مسألة الأسرار التجارية نظاما مكملا لبراءة الاختراع بدليل أن احتفاظ المخترع ببعض الأسرار يحقق له حماية لاختراعه وكذا استغلال اختراعه بالإضافة للاستفادة المالية من خلال عقود نقل التكنولوجيا وعقود التراخيص. Abstract Trade secrets are part of the intellectual property system, due to its connection to the issue of technology transfer, which is often the subject of technology transfer contracts, and from here emerges the relationship between the two issues as this study aims to highlight this relationship and its results, and given the desire of developing countries to integrate into the international economy By gaining the progress and technological secrets that have been reached according to the technology transfer process, it considers trade secrets a constraint on technology transfer because it is costly for them, in addition to that this system leads to keeping a lot of information secret for a long time, which deprives society of benefiting from it unlike Disclosure, which is the goal of technological upgrading, In contrast, developed countries consider the issue of trade secrets as a complement to the patent system, evidenced by the fact that the inventor's retention of some secrets achieves protection for his invention as well as the exploitation of his invention in addition to financial benefit through technology transfer contracts and licensing contracts.
