الملخص
الملخص: للقاضي الإداري الاستعجالي دور جوهري في فض منازعات الصفقات العمومية،ذلك بالنظر إلى السلطات الهامة والمحورية التي يتمتع بها في مرحلة الإبرام،حيث يؤول له توجيه أوامر للإدارة وتأجيل عقد الصفقة وكذا فرض الغرامة التهديدية على المصلحة المتعاقدة،عند إخلالها بالتزامات الإشهار وقواعد المنافسة وذلك من خلال استحداث دعوى استعجالية للنظر في منازعات الصفقات العمومية. الكلمات المفتاحية: قاضي إداري- استعجال - صفقة عمومية- دعوى . Abstract: The emergency administrative judge has a fundamental role in resolving public procurement disputes ,this is in view of the important and pivotal powers that he has at the conclusion stage,as he suggests orders to the administration and postpones the conclusion of the deal,as well as imposing a threatening fine on the contracting interest, when as imposes a threatening fine on the contracting interest when it breaches the advertising obligations and competition rules, by introducing an urgent case to consider public procurement disputes. key words: Administrative judge - urgency – public deal- procedure .
