التوقيع الإلكتروني كآلية لتوثيق المعاملات الإلكترونية Electronic Signature As A Mechanism For Documenting Electronic Transactions

الملخص
الملخص: لم تعد الوسيلة التقليدية في اثبات وتوثيق التعاملات الورقية، وهي التوقيع الخطي أو اليدوي ملائمة للصورة الحديثة للتعاملات التي أخذت الشكل الإلكتروني، والتي يتعذر معها توافر هذا التوقيع، لذا ظهر بديل عن التوقيع الخطي اليدوي التقليدي توقيعا حديثا إلكترونيا يتماشى مع طبيعة هذه المعاملات. وحتى يكون لهذا التوقيع الإلكتروني نفس الحجية التي يتمتع بها التوقيع الخطي لابد من استيفائه لشروط ومتطلبات للاعتداد به كتوقيع كامل وذلك من خلال تحقيقه لدوره ووظيفته في الإثبات. Abstract: It is no longer the traditional way of proving and documenting paper transactions, namely, the manual signature which is not appropriate for the modern image of the transactions that took the electronic form, where this signature is not available. Therefore, an alternative to the traditional hand-written signature appeared newly electronic signature is consistent with the nature of these transactions. In order for this electronic signature to be as authoritative as that of a written signature, it must be fulfilled to the conditions and requirements to be recognized as a complete signature, through the achievement of its role and function in the proof.
