الملخص

نتيجة للأضرار التي قد يتسبب بها السلوك الصادر من الموظف العام سواء عن جهل أو عن قصد لدى تعامله بالمعلومات والوثائق الإدارية بسبب منصبه أو المهمة الموكلة إليه، ونتيجة للخطورة التي تنطلي عليها من مساس بمصالح المرفق العام المتواجدة على مستواه تلك الوثائق، تدخل المشرع الجزائري بموجب الأمر رقم 21-09 ليضفي حماية قانونية على تلك الوثائق، فيضمن بذلك أمن واستقرار المرافق العامة ومؤسسات الدولة، غير أن تلك الحماية قد تمس بمبدأ الشفافية الإدارية الذي يقضي بضرورة نشر المعلومة الإدارية وتمكين المواطن من الحصول عليها، وقد توصلت الدراسة إلى العديد من النتائج أهمها ضرورة وضع ضوابط ومعايير لتحديد طبيعة الوثائق والمعلومات التي يجب نشرها وتلك التي يجب كتمانها والحفاظ على سريتها. As a result of the damage that may be caused by the behavior issued by the public official, whether ignorantly or intentionally, when dealing with information and administrative documents because of his position or the task entrusted to him, and as a result of the danger that he is taking from compromising the interests of the public utility that are at the level of those documents, the Algerian legislator intervenes according to the order No. 09-21 to confer legal protection on these documents, thus ensuring the security and stability of public facilities and state institutions. However, this protection may affect the principle of administrative transparency, which requires the need to publish administrative information and enable citizens to obtain it. The study reached many results, the most important of which is the necessity of Establishing controls and standards to determine the nature of documents and information that should be published and those that should be kept secret and kept confidential.
