المركز القانوني لرئيس الجمهورية في ظل التعديل الدستوري 2020

الملخص

كرس التعديل الدستوري 2020 وضعا قانونيا جديدا لرئيس الجمهورية، ويظهر ذلك من خلال التقسيم والتفصيل الجديد للسلطات الدستورية في الدولة، حيث تم التخلي عن التقسيم التقليدي المعروف في كثير من دساتير الدول، وفي الدساتير والتعديلات الدستورية السابقة في الجزائر، فتم اعتماد فصول مستقلة خاصة بكل سلطة على حدى، بدءا برئيس الجمهورية، ثم الحكومة، ثم البرلمان، ثم القضاء. والهدف الأساس من ذلك اخراج رئيس الجمهورية من السلطة التنفيذية باعتباره مجسد للدولة والأمة، وحامي الدستور، لا يملك صلاحيات تنفيذية، بل تبقى للحكومة التي تنفذ ما يصدر عن رئيس الجمهورية من أوامر ومراسيم، وما يصدر عن البرلمان من قوانين. The Constitutional Amendment of 2020 adopted a new legal status for the President of the Republic. This new vision is reflected by the new division of the constitutional authorities of the State. As the traditional division known in many State constitutions and in Algeria's previous constitutions and amendments was abandoned. Separate chapters were adopted for each authority, starting with the President of the Republic, then the government, then parliament, and then the judiciary. The main objective is to give fewer powers to the President of the Republic in the executive branch, since he is the embodiment of the State and the nation, and the protector of the constitution. He has no executive powers. It is the government that executes the decrees of the President of the Republic and the laws of Parliament.
