إنضمام المـرسل إليـه لعقد النـقل الـدولي للبضـــائع – تصور إستثنائي– تـبرره الوظيفة الإقتصادية The Accession Of The Consignee To The Contract Of International Carriage Of Goods - Exceptional Concept - Justified By The Economic Function

الملخص
إن مبدأ نسبية العقد يقضي بعدم إنصراف أثار العقد لغير عاقديه، ومن ثمة لا ينبغي أن يستفيد الغير أو أن يضار من علاقة عقدية هو أجنبي عنها، إلا في بعض الحالات التي حددها القانون وأقرها الفقه والقضاء كما هو الحال بالنسبة لمركز المرسل إليه في عقد النقل الدولي للبضائع، حين تفرض الممارسة التجارية في البيوع الدولية تدخل شخص ثالث لإتمام عملية النقل، فالمرسل إليه (المشتري) رغم أنه لم يساهم في إبرام عقد النقل البحري بين كل من الشاحن (البائع) والناقل، غير أن أثاره سوف تمتد إليه بموجب سند الشحن في ظل تنفيذ هذا النوع من العمليات الإقتصادية ثلاثية الأطراف خروجا عن الأصل العـام. Abstract: The principle of the relativity of the contract requires that the effects of the contract are not left to the non-contracting parties, and therefore a third party should not benefit or be harmed from a contractual relationship that he is foreign to, Except in some cases specified by law and approved by the doctrine and jurisprudence, as is the case for the status of the consignee’s in the contract of international carriage of goods, when commercial practice in international sales necessitates the intervention of a third person to complete the transport process. The consignee (the buyer), although he did not participate in the conclusion of the maritime transport contract between the shipper (the seller) and the carrier, but his effects will extend to him under the bill of lading in light of the implementation of this type of three-party economic operations in departure from the general origin.
