إبعاد وطرد الأجانب كآلية للحد من الهجرة غير الشرعية

الملخص
تعتبر حرية التنقل حق من حقوق الإنسان، وهي مضمونة سواء للمواطنين الجزائريين والأجانب على حد سواء، وبغية معالجة الهجرة غير الشرعية استحدثت الجزائر جملة من الآليات القانونية لمواجهة هذه الظاهرة الخطيرة تضمنتها جملة من التشريعات ويأتي في مقدمتها القانون رقم 08/11 المتعلق بشروط دخول الأجانب إلى الجزائر وإقامتهم بها وتنقلهم فيها. وهذا نظرا للتطور الكبير لظاهرة الهجرة غير الشرعية، ونتيجة ذلك جاء المشرع الجزائري بإجراءات قانونية صارمة في التعامل مع الأجانب الذين يدخلون إلى الجزائر بصفة غير شرعية أو يقيمون فيها بصفة غير قانونية، أو يمارسون أنشطة تخالف قوانين وأنظمة الدولة، ويأتي في مقدمة هذه الإجراءات، طرد أو إبعاد كل أجنبي غير مرغوب فيه، والذي يشكل وجوده خطرا على النظام العام أو الأمن، أو الذي قام بأنشطة تتعارض مع المصالح العليا للبلاد، أو التي من شأنها المساس بالسلم الاجتماعي أو الآداب العامة. Freedom of movement is a human right, guaranteed both for Algerian and foreign citizens, and in order to address illegal immigration, Algeria has introduced a number of legal mechanisms to address this dangerous phenomenon, including a series of legislation, notably Law 08/11 on the conditions for foreigners to enter, reside and move into Algeria. This is due to the significant development of the phenomenon of illegal immigration, and as a result the Algerian legislator has introduced strict legal procedures in dealing with foreigners who enter or reside in Algeria illegally, or engage in activities contrary to state laws and regulations, and at the forefront of these measures is the expulsion or deportation of any undesirable foreigner, whose presence poses a threat to public order or security, or who has engaged in activities contrary to the country's best interests, or which would prejudice social peace or public morals.
