الضحية في الجرائم الدولية من التهميش الى الاقرار بالحقوق

الملخص
عانت ضحايا الجرائم الدولية من التهميش لفترة طويلة، سواء أمام القضاء الجنائي الدولي العسكري أو الخاص، إذ لم تتمكن من المطالبة بحقوقها كضحية الجرائم الدولية المعاقب عليها من قبل هذه المحاكم. بوضع اتفاقية روما لعدالة جنائية دولية دائمة، تمكنت الضحايا ولأول مرة في تاريخ القانون الجنائي الدولي من إيجاد تعريف لها وكسب مكانة أمام المحكمة بصفة مباشرة، كما تم إنشاء صندوق استئماني ضمانا لحقوقها مما يشكل سابقة لا مثيل لها في القضاء الجنائي الدولي. أصبح بإمكان ضحايا الجرائم الدولية المعاقب عليها أمام المحكمة أن تشارك بصفة مباشرة في إجراءات المحاكمة وتقديم طلب جبر الضرر الذي أصابها دون اللجوء إلى القضاء الوطني كما كان معمول به سابقا. برغم ذلك تبقى ضحايا الجرائم الدولية بحاجة إلى مزيد من الدعم خاصة أن حق اللجوء إلى المحكمة الجنائية الدولية غير مقرر لفئة الضحايا كما لباقي الأطراف الأخرى. Victims of international crimes have been for a long time suffering from marginalization, either before the international military or private criminal courts, since they could not claim their rights as victims of international crimes punished by these courts. With the creation of the Rome Convention related to permanent international criminal justice, victims were able for the first time in the history of international criminal law to define themselves as such, and gain a status in direct capacity before the court. A Trust fund was created in addition to guarantee victims’ rights ; and this is unprecedented in the international criminal justice. Victims of international crimes punished in courts can henceforth directly participate in the trial procedure, and submit a request for reparation of the damage they suffered from, without resorting to the national judiciary previously in force. This stated, victims of international crimes still need more support, especially because the right to resort to the International criminal court is not recognized for the category of victims as for the other parties.
